Scope of application

These General Terms and Conditions (hereinafter referred to as 'GTC') shall apply to all contracts concluded by Aristonet Handels GmbH, Weg zum Reinerkogel 41, A-8010 Graz (hereinafter referred to as '7SEALSWHISKY.at') with persons or companies having their place of residence or registered office in Austria (hereinafter referred to as 'customer') for products (hereinafter referred to as 'products') offered in the Aristonet Handels GmbH web shop (hereinafter referred to as 'web shop'). By placing an order in Aristonet Handels GmbH's webshop, the customer accepts these GTC.
Deliveries, services, offers, etc. of Aristonet Handels GmbH via the webshop shall be made exclusively in accordance with these GTC. The GTC shall apply in the version current at the time of conclusion of the contract. Aristonet Handels GmbH reserves the right to amend these GTC at any time.


 
User account / Customer's details

The customer places orders via a user account or as a guest in Aristonet Handels GmbH's web shop. All information provided by the customer in the user account and all information provided as a guest must be complete and true. Each customer may open only one user account.


 
Conclusion of contract and delivery

The contract between Aristonet Handels GmbH and the customer is only concluded by an express order confirmation (not by the automated summary of the order sent by email) or by the confirmation of dispatch by Aristonet Handels GmbH and is conditional on the availability of the products ordered. The buyer remains bound by the order until Aristonet Handels GmbH's express confirmation of the order or confirmation of dispatch.
Aristonet Handels GmbH's offer is primarily aimed at end consumers, which is why Aristonet Handels GmbH reserves the right not to fulfil or to reject orders in particular if, in Aristonet Handels GmbH's view, quantities of products are ordered that are not customary for end consumers.
For the products ordered by the buyer, the prices in EURO valid on the date of the order and stated in the web shop shall apply, including VAT and excluding shipping costs, provided that the total order value (excluding VAT) does not exceed EURO 100.00. The shipping costs shall be calculated during the order process. The shipping costs are shown separately during the ordering process and in the order confirmation.
Aristonet Handels GmbH delivers exclusively to delivery addresses within Austria. Aristonet Handels GmbH shall determine the shipping route and type of packaging. Partial deliveries are permitted; any additional shipping costs incurred as a result shall be borne by Aristonet Handels GmbH.
Delivery dates and/or deadlines stated or notified by Aristonet Handels GmbH are not binding. If the delay exceeds twenty days or if it is impossible to deliver for more than twenty days, the customer and Aristonet Handels GmbH shall be entitled to withdraw from the contract without compensation.

 
Terms of payment

Payment for all orders shall be made in EURO against invoice.
Invoices from Aristonet Handels GmbH must be paid within 30 days (without deduction). Aristonet Handels GmbH will charge a handling fee of EURO 40.00 after the third reminder.
In the case of orders against invoice, Aristonet Handels GmbH is entitled to demand payment in advance without giving reasons (e.g. due to insufficient creditworthiness).
In the case of payment against invoice, ownership of the goods delivered shall not pass to the customer until the purchase price has been paid in full.

 

Inspection, warranty and liability

The customer shall immediately check the consignments or products received for correctness, completeness and freedom from defects. Any deviations from the order and any defects must be notified to Aristonet Handels GmbH in writing within 5 calendar days of delivery.
Aristonet Handels GmbH warrants only that the products ordered are free from defects in materials and/or workmanship at the time of delivery to the customer. Any defects must be notified to Aristonet Handels GmbH in writing, giving a detailed description of the defects and enclosing the complete, defective product and the dated proof of purchase in the case of private use of the product within 2 years of the date of purchase (in the webshop). In the case of commercial use, a defect must be reported within 1 year from the date of purchase (in the web shop), otherwise Aristonet Handels GmbH shall have no warranty obligation whatsoever.
Wear and tear as well as consequences of improper or careless use, neglected care and attempted repairs by the customer or third parties do not constitute defects.
The warranty obligation may be fulfilled by Aristonet Handels GmbH at its own discretion by repair, replacement (with an identical or similar device), reduction of the purchase price or by reimbursement of the purchase price. Other services, in particular compensation for damages, are excluded in the event of a defect.
By purchasing the products, the customer undertakes to use them solely for the purpose for which they are intended.
Any further liability of Aristonet Handels GmbH in connection with products or services of Aristonet Handels GmbH and its auxiliary persons is excluded to the extent permitted by law.


 
Data security and data protection

Data is transmitted via the Internet. The Internet is an open network accessible to anyone and is therefore not generally considered to be a secure environment. All payment transactions are processed in accordance with the security standard customary at the time of the transaction ("https://"). Aristonet Handels GmbH accepts no liability for the security of data during its transmission via the Internet.
Personal data is processed in accordance with and in compliance with the applicable data protection regulations for the purpose of processing the contract and maintaining relations with the customer (including marketing measures).
The disclosure of the customer's personal data to third parties outside Aristonet Handels GmbH shall be exclusively to the service partners involved in the processing of the contract, such as the logistics company commissioned with the delivery. In such cases, the scope of the transmitted data is limited to the minimum required for the processing of the contract. Customer data will not be passed on to third parties in any other way. The customer agrees to the collection, processing and use of his personal data in accordance with the aforementioned instructions.
Furthermore, the terms and conditions for the use of the web shop's website, which can be called up under the heading Data Protection, also apply to buyers.


 
Applicable law and place of jurisdiction

The contractual relationship, including these Terms and Conditions, shall be governed exclusively by Austrian law, to the exclusion of the conflict of laws provisions of Austrian private international law, in particular to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention). The place of jurisdiction is Graz, whereby Aristonet Handels GmbH is also entitled to take legal action against the customer at the customer's general place of jurisdiction.
